Colorado has introduced a new requirement for nonprofits seeking to fundraise in the state. Before a nonprofit can register for charitable solicitation, it must now be officially registered as a business entity with the Colorado Secretary of State. This step is referred to as “corporate registration” or “foreign qualification,” which indicates that your organization is authorized to operate in the state.
This update is especially important for nonprofits based outside of Colorado. If your nonprofit is formed in another state but wants to ask for donations from Colorado residents, you may now need to register your organization with the Colorado Secretary of State first, and then complete the charitable solicitation registration.
What This Means for Your Organization
Corporate registration and charitable solicitation registration are two separate filings. Corporate registration enables your nonprofit to operate legally in Colorado. Charitable solicitation registration enables your nonprofit to solicit donations and conduct fundraising campaigns.
