Florida has passed a new law that affects how nonprofit organizations can raise funds in the state. Starting July 1, 2025, nonprofits registered to solicit donations in Florida must follow stricter rules about where their donations come from and how they operate. These changes are important to understand so your organization can continue to meet Florida’s regulatory requirements and maintain good standing.
What the New Law Says
The new law says that charitable organizations in Florida are not allowed to ask for or accept donations from “foreign sources of concern.” These include certain foreign governments, businesses, and individuals who are tied to countries listed in Florida Statute § 286.101. Even if your organization receives money from these sources by accident, it can still be a problem. While first-time mistakes may be forgiven if fixed quickly, repeated violations could lead to serious penalties or even criminal charges.
New Attestation for Political Activities
The law also introduces new rules about political activities. When your organization first registers or renews its charitable registration in Florida, an authorized representative must now answer questions about whether the group is involved in political work. If your organization is doing anything that falls under Florida’s election laws (Chapter 106), you’ll need to prove that you're properly registered with the state. If your organization is not allowed to engage in political activities, you must confirm that you are not doing so.
These steps are meant to prevent charities from being used for political purposes without following the proper legal process.
Honest Services Registry
Florida is also creating something called the Honest Services Registry. This is a public list of organizations that certify they don’t accept money or messaging support from foreign sources of concern. Being included on this list is optional, but it may help show donors and the public that your organization is committed to transparency.
How This Affects Your Organization
If your nonprofit is registered to raise funds in Florida, you’ll need to start reviewing your donor vetting processes. It’s important to know where your contributions are coming from and to keep good records. You should also review your governance policies and make sure any political activities are clearly documented and follow all laws.
The Florida Department of Agriculture and Consumer Services is still working on the final rules, and registration forms haven't changed yet. But the law is in effect starting July 1, 2025, so it's smart to start preparing now.
