West Virginia Certificate of Authority
West Virginia has begun requiring organizations to include a West Virginia Certificate of Authority if a charity engages in any fundraising that takes place in the state. If the organization does not conduct business in the state, it may instead submit an Exemption for Certificate of Authority. West Virginia determines whether a Certificate of Authority/Exemption is required based off of the methods of solicitation that the organization lists on their annual registration form. If solicitation methods such as Special Events, TV, or Radio are listed, the state assumes that these are taking place within the State of West Virginia and thus that a Certificate of Authority or Exemption is needed.
