Company Licenses

South Dakota Nonprofit & Fundraising Company Licenses

South Dakota Charitable Gaming License

Not required



Charitable Gaming licensure is not required on the State level in South Dakota.

There is no state level licensing for games of chance in South Dakota, however, charities must provide written notice to the county or municipality where the game or raffle is held at least 30 days prior to the event. In addition, if a charity conducts a statewide lottery, the secretary of state must be notified in writing.

South Dakota Charitable Gift Annuity Registration

Not required



Charitable Gift Annuity licensure is not required on the State level in South Dakota.

No filing is required, but charities need to be registered or foreign qualified with the secretary of state and meet certain conditions before issuing charitable gift annuities. South Dakota exempts 501(c)(3) charitable organizations as well as qualifying educational institutions from insurance regulation related to charitable gift annuities.

  • Some South Dakota counties and municipalities may require charities that solicit in-person to register prior to fundraising.

Commercial Co-venturer licensure is not required on the State level in South Dakota.

South Dakota does not currently have a traditional registration requirement for commercial co-venturers, but they may need to follow other regulations before and after fundraising events.

Fundraising Counsel licensure is not required on the State level in South Dakota.

South Dakota Professional Fundraiser Registration

Professional Fundraiser licensure is not required on the State level in South Dakota.

Although South Dakota does not have a general license requirement for professional fundraising, fundraisers that make telephone solicitations may need to obtain a telephone solicitation registration.

Professional Solicitor licensure is not required on the State level in South Dakota.

Solicitors who are not employed by a professional fundraising firm but operate independently may be required to register. Employees of professional fundraising firms are generally not required to register as an individual solicitor in South Dakota.
