Texas Charitable Organization Registration
Agency: Texas Secretary of State - Registrations Unit
Bond Requirements: Veteran's organizations have a bond requirement of $5,000 if the solicitor solicits in only one county, $10,000 if the solicitor solicits in more than one county but fewer than six counties, or $25,000 if the solicitor solicits in six or more counties.
Foreign Qualification is Prerequisite: No

Automatic Exemption
Agency Fee: $0
Notes: Only certain public safety organizations, independent promoters, public safety publications, veterans organizations, and telephone solicitors are required to register. All other charities are automatically exempt.
Initial Registration
Form: Form 3201: Public Safety Organization, Independent Promoter, or Public Safety Publication Registration/Renewal Statement or Form 3501: Veterans Organization Solicitation Registration Statement
Agency Fee: $150 for veterans organizations and $250 for public safety organizations

Domestic Applicants:
1. File entity formation documents with the Texas Secretary of State.
2. Submit a registration form and all required attachments to the Texas Secretary of State - Registrations Unit.
Foreign Applicants:
1. Determine whether or not your charity will need to foreign qualify based on your activity in Texas. If not required, skip to number 3.
2. File foreign qualification documents with the Texas Secretary of State.
3. Submit the online form or Charitable Organization Registration Form and all required attachments to apply for registration with the Texas Secretary of State - Consumer Interest Division.

Texas Commercial Co-Venturer Registration
NOT REQUIRED
Commercial Co-venturer licensure is not required on the State level in Texas.
Texas does not currently have a traditional registration requirement for commercial co-venturers, but they may need to follow other regulations before and after fundraising events.
Texas Charitable Gift Annuity Registration
NOT REQUIRED
Charitable Gift Annuity licensure is not required on the State level in Texas.
Texas does not distinguish between annuities issued by charitable and for-profit entities.

Fundraising Counsel licensure is not required on the State level in Texas.

Professional Fundraiser licensure is not required on the State level in Texas.
Texas does not currently have a traditional registration requirement for professional fundraisers, but they may need to follow other regulations before and after fundraising events.
Texas Individual Professional Fundraiser Registration
NOT REQUIRED
Professional Solicitor licensure is not required on the State level in Texas.
Solicitors who are not employed by a professional fundraising firm but operate independently may be required to register. Employees of professional fundraising firms are generally not required to register as an individual solicitor in Texas.
